1.2. Concepts
Seller: the operator of the Web Store, which provides the service of selling goods offered in the Web Store 1.1. individual entrepreneur defined in point
Buyer: the natural or legal person or organization without legal personality that enters into a sales contract with the Web Store.
Parties: the contracting parties included in the sales contract, the Seller and the Buyer together.
Consumer: a natural person acting outside the scope of his profession, independent occupation or business activity, user.
Sales contract: a contract between the Parties for the transfer of ownership of goods selected by the Customer from the Web Store's offer.
Product: product offered for sale by the Seller in the Web Store.
Purchase price: the price at which the Seller offers the goods for sale.
Delivery: delivery of the goods that are the subject of the sales contract to the address specified by the Buyer and handing them over to the Buyer (or his agent).
Supplier: Courier service or postal carrier contracted with the seller.
Delivery fee: consideration for the delivery service provided by the Supplier. The delivery fee is the amount to be paid as consideration for the delivery of the goods in addition to the purchase price.
Online store: a service provided electronically, for those who are absent, in return for a fee, to which the user of the service has individual access.

1.3. General presentation of the Webshop
The Web Store is available on the puzzlegarden.hu page. The products on offer are jigsaw puzzles and their accessories and accessories.
In order to make a purchase in the Webshop, you need to register in advance. During registration, the Customer must provide the data requested by the system (name, billing and delivery address, e-mail address, telephone contact) in accordance with reality, and the Customer is responsible for any damages resulting from the failure to provide the data in the correct manner. An additional condition for purchasing in the Webshop is that the Buyer must accept these General Terms and Conditions, which he/she declares with the order.
In connection with the operation of the Online Store, the Seller handles personal data in accordance with the relevant Act CXII of 2011 on the right to self-determination of information and freedom of information. performed in compliance with the law. The data protection information of the Webshop can be found separately on the website. In the case of a purchase in the puzzlegarden.hu web store, as described in these General Terms and Conditions, the Buyer makes a purchase offer with the order, the confirmation of which creates a sales contract between the Seller and the Buyer. The created contract is considered a written contract, which is created with a legal declaration made electronically. The Seller records the contract according to its number from the date of purchase to the last day of the 5th calendar year for the purpose of fulfilling its accounting and warranty obligations.
The day of purchase is the day of order confirmation. The language of the contract is Hungarian. The contract falls under the scope of Hungarian law, in the event of a legal dispute, Act V of 2013 on the Civil Code shall apply to the relationship between the Parties.

II. PROCESS OF ELECTRONIC CONTRACTING (PURCHASE).

2.1. Presentation of the goods, prices, discount products
In the Webshop, all goods are presented with pictures and descriptions, which make it easier for the customer to choose the goods and make the decision to buy. In addition to all this, we draw your attention to the fact that the images on the pages are for illustration purposes only, the actual products may differ from those shown in the image. Depending on the resolution of the monitor, the actual colors may differ from those shown in the picture. The prices on the pages include/exclude VAT. The Web Store reserves the right to change prices without prior notice. Our prices and the range of our products can constantly change and expand. In case of a possible price change, the goods already ordered will be delivered at the applicable price on the day of the order. We sometimes offer promotions in the Webstore, the individual promotions are clearly indicated by the Webstore, indicating the products included in the promotion and the relevant discounts. In the case of sale items, the sale always lasts until the specified date or until stocks last.

2.2. Selection of goods, purchase process
The product is selected by placing it in the "Basket". After that, it is possible to select new goods and place them in the basket, to remove selected goods from the basket, to modify the customer's data, or to place the order. If the Buyer has finished selecting the goods, the data required for the purchase (buyer's name, delivery address, e-mail address, telephone number) will be automatically loaded by the system based on the preliminary registration. The Seller may process the natural personal identification data and address necessary for the identification of the Buyer for the purpose of creating the contract, determining its content, amending it, monitoring its performance, invoicing the fees arising from it, and asserting related claims. By finalizing the order, the Customer consents to the processing of his personal data in accordance with the provisions of this contract. After entering the data necessary for the purchase, before finalizing the order, the Buyer has the opportunity to modify his order, remove goods from it, change the number of pieces, or order new goods. There is also a way to check and, if necessary, correct the provided customer data. With the order, the Buyer makes a purchase offer, upon confirmation of which a sales contract is created between the parties.

2.3. Shipping fee
The goods can be received by delivery or personal collection. Before finalizing the order, the Buyer will receive adequate information about the delivery fee of the goods, and the amount of the delivery fee will be accurately indicated on the invoice issued by the Seller. The Buyer must pay the delivery fee in accordance with the chosen payment method together with the price of the goods, which is exclusively specified in 2.5. is possible according to point

2.4. Order confirmation
The Web Store will confirm the order immediately, but no later than within 48 hours, by electronic mail sent to the e-mail address provided by the Customer. The confirmation contains a list of the ordered goods and their prices, the name and delivery address provided by the Buyer, the delivery cost and the registration number of the order. If the confirmation is not made within 48 hours, the Buyer is released from the obligation to make an offer. The Customer can monitor the processing of the order on the website of the Web Store by entering his username and password in his profile.

2.5. Payment
Payment can be made in the Webshop by bank transfer, online card payment or cash on delivery.

2.5.1. Transfer
The Buyer is obliged to pay the purchase price of the finalized order by bank transfer on the basis of the advance payment request issued by the Seller, by the payment deadline specified therein. The Seller performs and hands over the goods to the Supplier only after full payment of the advance payment. The original final invoice will be handed over or sent out at the same time as the product.
The order number included in the order acceptance confirmation must be indicated in the transfer notice column. The Seller does not assume any responsibility for damages resulting from failure to do so or incorrect indication of the order number, the damages and additional costs are borne by the Buyer.

2.5.2. Online bank card payment
The purchase price of the placed order can also be paid to the Seller directly after placing the order by online bank card payment. Online bank card payments are made through the Stripe system. The bank card data does not reach the merchant. The financial service provider: Stripe Technology Europe, Limited is an Irish limited company. Registered number: 0599050. Registered office: 25/28 North Wall Quay, Dublin 1, D01H104. Online credit card purchases are monitored and encrypted by the webshop operator (Shopify Inc.). In the integrated payment process, the Buyer must enter his name, bank card number, the expiration date of his bank card, and its security code. After that, the online payment will take place. In case of successful payment, the Customer will receive an e-mail about the payment, and the information about the successful payment will also be displayed in the Webshop. In case of unsuccessful payment, the information about the unsuccessful purchase is displayed in the Webstore.

2.6. Transport
The delivery of the goods to the delivery address specified by the Buyer is carried out by the Seller's contracted delivery companies, DPD Hungary Kft. (headquarters: 1134 Budapest, Váci út 33. 2nd floor,) or Foxpost Zrt. (headquarters: 3300 Eger, Maklári út 119.) or Packeta Hungary Kft. (headquarters: 1044 Budapest, Ezred utca 1-3. B2/11. ed.) hereinafter: Supplier. The Seller will notify the Buyer separately of the expected date of delivery when the goods are handed over to the Supplier. The Supplier may send a separate notification to the Buyer regarding the expected date of delivery. The performance is realized by delivery to the delivery address specified by the Buyer and by handing it over to the Buyer or his representative. The risk of damage is transferred to the Buyer upon delivery to the Supplier.

III. RIGHT OF WITHDRAWAL

3.1. Seller's right of withdrawal
If the Buyer does not complete the transfer by the payment deadline indicated on the advance request, but within 8 calendar days at the latest, the Seller may withdraw from the contract. The Seller has the right to withdraw from the sales contract even if the price of the goods was indicated incorrectly and the Buyer finalized the order at the incorrect price or if the order was confirmed for goods that are out of stock and the Seller is no longer aware of it to acquire within a suitable time. In the event of cancellation, the Seller will send its statement to the Buyer by e-mail, and the Seller will immediately contact the Buyer for the purpose of consultation, and will return any amount already paid by the Buyer by bank transfer to the Buyer's account within 30 days.

3.2. The Consumer's right of withdrawal
A natural person acting outside the scope of his profession, independent occupation or business activity (hereinafter: Consumer) may withdraw from the contract and return the ordered product within 14 days from the receipt of the ordered goods, starting from the finalization of the order. The right of withdrawal is exercised with the Consumer's clear declaration to this effect or in the format forming the annex to these General Terms and Conditions, a printed copy of which is sent to the User by the Seller, together with the information on the right of withdrawal, packaged with the product. The consumer can send his declaration in the form of electronic mail or by post. The Seller will immediately confirm receipt of the Consumer's cancellation electronically. In the case of exercising the consumer's right of withdrawal, the consumer will not be charged any costs other than the cost of returning the product. If the Consumer withdraws from the contract, he must return the goods immediately, but no later than within 14 days from the notification of withdrawal, or hand them over to the Seller or a person authorized to receive the goods, unless the Seller has agreed to transport the goods back himself. The return is deemed completed within the deadline if the Consumer sends the goods before the deadline.
Non-acceptance of cash-on-delivery goods is not subject to the Buyer's right of withdrawal, as it is not a clear declaration of intent to withdraw. If the buyer refuses to accept the cash on delivery item, the shipping and return costs will be charged to the buyer and will be invoiced.
The Seller will refund the purchase price to the Consumer using the payment method used by the Consumer immediately, but no later than within 14 days, after confirming the return of the goods in a way that leaves no doubt or their return. The Consumer is obliged to exercise the right of withdrawal in accordance with its intended purpose, without abusing this right. In the event of a cancellation that is considered an abuse, the Seller is exempted from the obligation to take back the goods and repay the purchase price. The Seller is only obliged to refund the full purchase price to the Consumer in the case of the return of the undamaged, unused, undamaged product. Costs resulting from damage to the packaging are borne by the consumer. The Seller is not responsible for goods lost during the return shipment. In the absence of the goods, the Seller is under no obligation. 45/2014. (II. 26.) The right of withdrawal defined in the government decree applies only to consumers, not to economic companies. The Civil Code 8:1. According to § 3, the consumer is nothing but a natural person acting outside the scope of his profession, independent occupation or business activity. In other words, legal entities and business associations are not entitled to the right of withdrawal. This also applies to the evening, if the Buyer requested the issuance of the accounting certificate or invoice in the name of a legal entity or business company. In other respects, the Consumer's right of withdrawal is regulated by EU Directive 2011/83 and 45/2014.
(II.26.) In accordance with the Government Decree, this GTC no. 1 The sample cancellation information form in the annex provides guidance by stating that the Consumer can exercise his right of cancellation in accordance with the present General Terms and Conditions no. 2. can do so by using the declaration sample attached to it, or by means of a clear declaration to that effect.

ARC. MODIFICATION OF AGREEMENT

Instead of exercising their right of withdrawal, the parties have the option to amend the contract by mutual agreement via e-mail. The buyer can request in writing to amend the contract and exchange the goods. The Seller is not obliged to accept the exchange request. If an exchange agreement is reached between the Parties, the costs of delivery and return will be borne by the Buyer. The seller can request an amendment to the contract if the ordered goods are out of stock and he wishes to replace them with other goods. The Buyer must accept this in writing (by electronic mail). The parties consider the oral contract amendment invalid.

V. WARRANTY

The seller assumes no responsibility for the warranty of undamaged packaged products. If the product is incomplete or damaged due to a manufacturing defect, the manufacturer of the product is responsible and a complaint must be submitted in the manner specified by him. The Seller undertakes to carry out this according to an individual agreement, if the Buyer requests it in writing. The deadline for processing these cases is 120 days.

VII. LAW APPLICABLE TO THE CONTRACT, METHOD OF SETTLEMENT OF LEGAL DISPUTES

In matters related to this contract, the current Hungarian legislation applies. For legal disputes arising from this contract, the Parties, if the legal dispute is governed by Article CXXX of 2016 on the Code of Civil Procedure. TV. (Pp.) falls under the jurisdiction of a local court, thus the exclusive jurisdiction of the Budakörnyéki Bíróság is stipulated.

VIII. SCOPE OF THESE GTC, FINAL PROVISIONS

The scope of the General Terms and Conditions covers the Seller as well as the Buyers. The scope of the General Terms and Conditions does not cover the financial institution processing the payment and the Supplier. The legal relationship between the Seller and the Buyer is established when the Buyer's order has been finalized, and in the context of this, the Buyer accepts these Terms and Conditions of the Service and a confirmation is sent to the Buyer electronically by the Seller. The date of entry into force of the valid text of the General Terms and Conditions is the date indicated on the website. The General Terms and Conditions are also available to the Customer in a format that can be saved and printed. In the event of a modification of the General Terms and Conditions, the provisions of the General Terms and Conditions valid as of the date of the order shall apply to ongoing orders. These General Terms and Conditions are effective from November 3, 2022 until the date of withdrawal or amendment of the General Terms and Conditions.
The seller reserves the right to unilaterally modify the General Terms and Conditions. The seller must publish the amendments on the puzzlegarden.hu website 15 (fifteen) calendar days before the amendment takes effect.
The seller is obliged to publish the current text of the General Terms and Conditions on its website.
The Buyer or the Buyer's representative undertakes to read the text of these Terms and Conditions in full before the first purchase or use of the service, and also undertakes to complete a transaction through the Online Store only after having read and understood the Terms and Conditions.
In matters not regulated in these GTC, the applicable Hungarian legislation, especially the provisions of Act V of 2013 on the Civil Code (Ptk.) shall govern.

Right of Withdrawal/Termination
You have the right to withdraw from this contract without reason within 14 days. Similarly, if the performance of the contract has begun in the case of a contract for the provision of services, you are entitled to terminate the contract without giving reasons within 14 days.
The withdrawal/termination period in the case of a contract for the sale of the product: expires 14 days after the day on which you or a third party indicated by you, other than the carrier, receives the product.
If you wish to exercise your right of withdrawal/termination, you must send a clear statement containing your intention to withdraw/terminate (e.g. by post or by electronic means) to the address of puzzlegarden.hu – Nóra Semsey ev (1024 Budapest, Szilágyi Erzsébet fasor 5., e-mail : puzzlegardenshop@gmail.com). For this purpose, you can use No. 2 as well as the withdrawal/termination declaration sample included in the appendix. You exercise your right of withdrawal/termination within the deadline if you send your withdrawal/termination statement before the expiration of the above-mentioned deadline.
Legal effects of withdrawal/termination
If you withdraw from this contract, we will immediately, but no later than within 14 days from the date of receipt of your withdrawal statement, refund all the compensation you have paid, including the cost of transport (except for the additional costs incurred due to the fact that you are the one offered by us, you chose a transport method other than the cheapest standard transport method.) During the refund, we use the same payment method as the payment method used during the original transaction, unless you specifically give your consent to use another payment method; you will not incur any additional costs due to the application of this refund method. We can withhold the refund until we have received the product back or you have not proven that you have returned it: the earlier of the two dates must be taken into account.
If you have received a product based on the contract, you must return or hand over the product to us without undue delay, but no later than 14 days from the date of notification of your withdrawal statement. The deadline is considered met if you send the product before the 14-day deadline.
You bear the direct cost of returning the product.
You can only be held responsible for the decrease in value of the product if it occurred due to use exceeding the use necessary to determine the nature, properties and operation of the product.
